PECo Smart Phone Contest Giveaway Rules

ELIGIBILITY: Open to legal residents of the United States, age 18 or older. Sweepstakes is void in any country where prohibited by law.
PROMOTION PERIOD: The promotion period is from the day the first contestant entered until the IMTS 2010 Trade Show, September 13-18, 2010.
HOW TO PLAY: Enter by calling PECo at 800.998.4191 or outside the USA: +1.937.667.7105 to discuss your Gear Inspection needs. Ask to speak to Lori Spencer and reference code PECo Secret.
SELECTION OF WINNING ENTRY: One winner will be selected in a random drawing during the IMTS 2010 Trade Show.
ODDS OF WINNING: Odds of winning are dependent on the number of entries received.
RELEASE: By entering the PECo promotion, participants agree, to the fullest extent permitted under applicable law, to release, discharge and hold harmless PECo, their affiliates, their respective owners, and representatives from any and all damages, liabilities, costs and expenses which may arise out of participation in Promotion or out of the acceptance, use, or misuse of prizes. By participating, you agree to these Official Rules and to the decisions of the judges whose decisions shall be deemed final and binding.
WINNER NOTIFICATIONS: Potential winners of each drawing will be notified by e-mail or by phone within seven days of the Promotion Period. Three attempts will be made to contact the winner within a 14-day period. If the potential winner fails to respond within 14 days of the last attempt or if the e-mail attempt is consistently undeliverable, the potential winner will be disqualified and a new winner will be determined. When the potential winner's postal address has been obtained they will be notified in writing by mail. Winners will be required to sign and return an Affidavit of Eligibility/Liability/ Publicity Release within 14 days of date printed on notification or they will be disqualified. Any notification returned as undeliverable will result in disqualification. For all failures of potential winners to respond, or undeliverable attempts as described herein, a new potential winner will be selected at random from among all applicable entries for that prize drawing. Prizes awarded within 30 days of receipt of executed affidavits. Except where prohibited by law, entry constitutes permission to use winners' names, hometowns, likenesses, prize won and photographs for online posting, and/or any advertising and publicity without additional compensation. All taxes on prizes are the sole responsibility of winners. PECo reserves the right to withhold taxes or other payments as deemed by it necessary or appropriate to comply with applicable law.
WINNERS LIST. Once a winner has been determined an email will be sent to all contestants. The winner will be posted on this site after the drawing.
TAMPERING: No responsibility is assumed for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof. Sponsor is also not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. The Sponsor reserves the right to withdraw and cancel the game if it becomes technically corrupted, (including if a computer virus or system malfunction impairs its ability to conduct the sweepstakes).
PRIVACY POLICIES / OPT-IN/OPT-OUT: All Participants agree that PECo may send additional promotional emails or advertisements to all participants as a term of entering the drawing and will continue to receive promotional emails or offers after the drawing occurs unless they unsubscribe.
PRIZE VALUE / TERMS OF SERVICE OF PRIZE: The cell phone will be a pre-paid phone and will come with a pre-paid card or pre-loaded with minutes. The number of pre-paid minutes will be determined at the time of drawing by PECo. Additional minutes beyond the minutes provided by PECo are the responsibility of the winner of the pre-paid cell phone. Total value of prize is estimated at $350.00.
OTHER PRIZES, INCENTIVES, AND OTHER OFFERS: PECo may at times offer prizes or incentives in order to gain new entrants into the Free Smart Phone Giveaway. Prizes and/or incentives offered at the time of entry are in no way connected to this contest/drawing and you agree and understand that they are to be considered separate offers entirely with rules and regulations applied to those offers by the companies contained within the offer and not by PECo.
